Privacy and Cookies Policy
This Privacy and Cookie Policy outlines how VDraw (referred to as "VDraw", "we", "us", or "our") handles information collection and usage practices. These practices apply to all websites that reference this policy, including vdraw.ai and any other websites or extensions where this policy appears (collectively referred to as "our Sites"). Additionally, this policy covers our analytical technology services that our clients implement on their websites and mobile applications (our "Services").
1.Information Collection Through Our Services and Its Usage
As part of our diverse offerings, we provide analytical tools that help advertisers, website and app developers, and third-party advertising platforms (collectively referred to as our "Clients") gain deeper insights into the effectiveness of their content, including online advertisements. For instance, we may assist Clients in understanding whether users tend to view their articles or advertisements, and if these materials appear in a visible manner. In delivering these services, we may collaborate with business partners who gather and share with us information collected from users' browsers or devices. The information gathered through our services (referred to in this Privacy and Cookie Policy as "Service Information") encompasses the following:
Log Information
When users visit websites where our services are implemented, our servers may automatically record information transmitted by each browser. These server logs may include information such as Internet Protocol ("IP") addresses (unique numerical identifiers automatically assigned to computers), timestamps, browser types, and users' engagement with our Clients' content and advertisements.
Mobile Data
Through mobile applications implementing our services, we (or Clients and other application providers we collaborate with) may similarly collect information about users' interactions with these applications (including IP addresses and timestamp information), as well as information about users' mobile devices (including device types, handset names, operating system details, mobile identifiers such as Apple IDFA and Android Advertising ID, application-specific identifiers, and a catalog of applications the devices interact with).
We, our business partners, or Clients may gather information about your browser, device, and your interaction patterns with web and mobile content through cookie IDs associated with your browser. We or they may deploy and read these unique identifiers, thereby passively "collecting" them, when you visit a site where our services are implemented or (regarding our business partners) where they otherwise engage with a user's browser. For additional information about these technologies, please refer to the section below titled "Cookies," "Pixel Tags," and "SDKs," and How We Utilize Them.
We may combine any of the above Service Information with each other, and we may also integrate it with information or inferences regarding users' engagement with advertisements, content, and webpages or applications that our clients provide or display ("Viewing Data").
2. Information We Collect On Our Site and How We Use It
When visitors access our site, we gather the following "Site Information" through both passive and active means:
Voluntarily Provided Information
You may choose to share personal details with us when subscribing to our newsletter, establishing an account on our platform, completing forms on our website, acquiring our products or services, or engaging with us through other channels. The information typically shared in these scenarios includes contact details (such as name, email address, and telephone number) or payment/billing information. Sharing this information is optional, however, without it you might not be able to access certain materials, features, or offerings.
User-Posted Content
You bear complete responsibility for any information you publish in public areas of our site. Despite our contractual efforts to restrict third-party usage through our Terms of Use, this information may be collected, used, and disclosed by us or third parties without limitations.
Cookies and Unique Identifiers
Similar to most web-based businesses, we employ automated mechanisms (such as cookies and pixel tags) with unique identifiers to monitor user interactions with our site. (For more information about these technologies, please refer to our section titled "Cookies," "Pixel Tags," and "SDKs" and How We Utilize Them.) We may employ our own technology (as described in Client Services above) for this purpose, and we may also utilize third-party services like Google Analytics, whereby those third parties collect information such as your IP address, browser type, the webpage that directed you to our website, and the timing of your visits to our site. Additionally, as you navigate our website, advertising cookies may be installed on your computer to help us understand your interests. Our display advertising partners may then assist us in delivering targeted advertisements to you on other websites based on your site interactions. To "opt out" of having your information used for such personalized advertising, please refer to our section titled "Your Choices and Opt-Out Options" to learn how to decline these services and receive generic, non-personalized advertisements instead.
Beyond the uses outlined above, we utilize this "Site Information" (independently or in combination) to provide, market, and operate our site and services. Among other functions, the Site Information we collect enables us to:
- Maintain and optimize the delivery of our site and services;
- Deliver requested product or service information;
- Address your questions, concerns, or customer service inquiries;
- Personalize content and advertisements you encounter on our site, across the internet, and elsewhere;
- Distribute marketing communications and other notifications.
We will only process personal information you provide to us or that we collect in accordance with applicable data protection regulations, including, for users located in the European Union, relevant laws implementing the Data Protection Directive 95/46/EEC and the Privacy and Electronic Communication (EC Directive) Regulations 2003.
3. How We Share the Service Information and Site Information
We share Service Information (such as Viewing Data) with our Clients and their service providers, as well as other platforms that may assist these Clients.
We share Site Information with companies that help us operate our platform and market our services, including for advertising our services, billing customers, analyzing Site users, providing customer and technical support, hosting services, and other operational support.
We may share both Site and Service Information in the following circumstances:
- As part of a business transaction such as a sale, merger, consolidation, investment, change in control, transfer of substantial assets, reorganization, or liquidation, or in connection with preparatory steps for such events (e.g., due diligence processes).
- With any subsidiaries that are partially or wholly owned by our corporate affiliates.
- With third parties that assist us in providing our Site or Services, including entities that help make our Site or Services available and functional, host our content and services, make available or transmit information we hold, assist with email distribution, process payments, manage customer information, or provide technical, customer, billing, administrative, event planning, marketing, or operational services to us or our Clients.
- When required by law or in response to legal processes, such as subpoenas, or when cooperating in good faith with requests from government or law enforcement agencies or officials.
- Where we believe sharing the information may prevent physical, financial, or other harm, injury, or loss; where we believe it necessary to protect our interests; or in connection with an investigation of suspected or actual unlawful activity.
We may also disclose your information under circumstances not mentioned here with the prior consent of the user who submitted the information to us.
4. “Cookies,” “Pixel Tags,” and “SDKs,” and How We Use Them
Cookies and Pixel Tags. Cookies are small data files containing character strings, such as anonymous unique browser identifiers. These files are stored on your computer or other device and function as identification tags for your device. When you visit our Site, our servers send a cookie to your browser or device, and our Clients and partners may do the same on their websites or through multi-site platforms. A pixel tag (also known as a web beacon or clear GIF) is an invisible 1 x 1 pixel placed on certain web pages. When you access these pages, pixel tags generate a notice of the visit and allow us to set or read cookies. Pixel tags work in conjunction with cookies to track activity on a site by a specific device. When cookies are disabled, pixel tags can only detect a unique website visit.
We (or our partners) may use cookies for various purposes, including to "remember" you (e.g., during site visits), track user trends, and collect information about how you use our Clients' sites or interact with advertising. We use cookies to deliver relevant content and replace non-relevant advertisements with ads that better match your interests.
We may employ several types of cookies:
Strictly necessary cookies: These are essential for the operation of our Site, enabling functions such as secure area login or e-billing services.
Analytical/performance cookies: These allow us to count visitors and analyze how users navigate our Site or our Clients' websites, helping improve website functionality by ensuring users can easily find what they need.
Functionality cookies: These recognize you when returning to our Site or our Clients' websites, allowing content personalization and preference storage (such as language or region selection).
Targeting cookies: These record your site visits, pages viewed, and links followed to make websites and advertising more relevant to your interests. We may share this information with third parties for targeting purposes.
Disabling Cookies. Most web browsers are configured to accept cookies by default. You can typically set your browser to warn you before accepting certain cookies or to refuse specific cookies. However, disabling cookies may limit functionality or make some website features inoperable. For more information about cookies and browser settings, visit www.aboutcookies.org.
Mobile Device Identifiers and SDKs. We sometimes use or partner with publishers or developer platforms that utilize mobile SDKs to collect information such as mobile identifiers (e.g., IDFAs and Android Advertising IDs) and data related to how mobile devices interact with our Services and those using our Services. A mobile SDK is essentially the mobile application equivalent of a pixel tag or beacon—computer code that app developers can incorporate to enable ad display, data collection, and related service implementation. For example, we might use this technology to analyze or measure advertising through mobile applications and browsers based on information associated with your mobile device. To opt out of personalized advertising on your mobile device, please follow the instructions in the "Your Choices and Opt-Out Options" section below.
In some cases, our Clients or partners may use these technologies (sometimes in combination with other data like IP addresses or hashed/de-identified data files) to coordinate user identities across platforms, browsers, or devices, to better analyze online or mobile audiences, or to target advertising and evaluate ad performance.
5. Your Choices, and Your Opt-Out Options
We occasionally collaborate with companies that collect anonymous or de-identified data to develop targeting attributes based on users' online browsing behavior. You may opt out of these third-party services (and learn more about them) by visiting the Digital Advertising Alliance's opt-out page, the Network Advertising Initiative's opt-out page, or, for European users, www.youronlinechoices.com. Please note that using these opt-out pages generally only disables these companies' "third party" ad targeting features; you will continue to receive non-personalized advertisements.
Similarly, to provide or utilize our Services, we (or Clients and partners we collaborate with) may employ other information gathered from users during online activities (such as IP addresses), combined with data collected across various websites and mobile applications, and from different devices or browsers. The industry-provided opt-out pages mentioned above can also help you opt out of many such services. Additional consumer choice tools are available through the website, including the browser extension, and information about the Control application that allows you to enable information "opt outs" for mobile applications or websites.
To opt out of our data service, please follow these steps:
- Download and install the extension (which offers various opt-out choices and allows you to block our data collection);
- Once installed, enable the Ghostery Findings Panel;
- When our service appears in the Ghostery Panel, you can block it from collecting data.
Please be aware that Ghostery may implement updates or changes to its features, and they (not we) control those features.
We also occasionally work with companies that capture advertising identifiers from mobile devices. You can opt out of using these identifiers for interest-based advertising purposes by accessing your phone's settings.
6. Third Parties on our Own Site
Third parties commonly collect visitor information directly from our Site users through automated technologies like cookies and pixels—a practice typical across most websites. Flash cookies, for example, might be utilized by our third-party video hosting provider to store preferences such as your volume control settings. While your browser offers cookie management tools, these may not effectively control all cookie types, particularly Flash cookies. For guidance on adjusting Flash cookie privacy and storage settings, follow the link provided.
The collection of non-personally identifiable information about your browsing behavior—both on our Site and elsewhere online—enables our advertising network partners to deliver interest-based advertisements tailored to your preferences. Should you wish to prevent your information from being used for this targeted advertising purpose, opt-out options are available through the methods described in our "Your Choices" section above. Be aware that opting out won't eliminate advertisements entirely; rather, you'll continue receiving generic ads without personalization.
Our Site frequently incorporates embedded third-party content and provides links to external websites and content sources. These third parties maintain their own privacy policies, which typically differ from ours, and operate independently from our service. We cannot assume responsibility for the privacy practices implemented by these external websites or content providers. Accessing such linked content or websites remains entirely at your discretion and risk. We strongly recommend reviewing the applicable privacy policies of these third parties to understand their information collection and handling procedures.
7. Data Protection Measures
We implement various safeguards to defend against unauthorized access, alteration, interference, disclosure, or destruction of the information we gather and maintain. These protective strategies may include conducting internal assessments of our data collection, storage, and processing protocols, as well as deploying comprehensive security infrastructure. Our server environments are shielded by advanced firewall technology and physically housed in high-security data facilities to enhance protection levels.
It's important to acknowledge, however, that no protection system achieves perfect security. Despite employing a diverse range of precautionary measures to prevent unauthorized access to our collected and stored information, we cannot provide absolute assurance against inadvertent disclosure or sophisticated unauthorized access attempts by third parties. Security remains an ongoing priority, but like all systems, ours has inherent limitations that we continuously work to address.
8. Cross-Border Data Transfers
In connection with the purposes outlined above, we may transfer personal information collected from you to our systems, third-party data processors, or affiliated companies located in various countries worldwide. The information we collect is typically stored on servers in the United States or other international territories.
We want to make you aware that jurisdictions outside your country of residence may operate under different data protection standards than those established in your home country. However, regardless of where your data is transferred or stored, our handling of your personal information remains governed by the principles and practices detailed in this Privacy and Cookies Policy.
When transferring your data internationally, we maintain appropriate safeguards while recognizing the global nature of our operations and services. These international transfers enable us to provide seamless services while working with specialized partners across different regions, though we remain committed to protecting your information according to the standards outlined throughout this policy.
9. Your Privacy Rights
Residents of Australia and European Union Member States are entitled to the following specific rights regarding their personal information:
You have the right to request access to or copies of personal information we maintain about you. While such requests may be subject to legally specified processing fees, making the initial request itself is free of charge. We will respond within a reasonable timeframe to all access requests.
We may decline access requests in certain circumstances as permitted by applicable privacy laws. Should we deny your request, we will provide a written explanation outlining our reasons (unless providing such reasons would be unreasonable) along with information about available complaint mechanisms.
You may request that we update or correct any outdated, incorrect, or inaccurate personal information in our systems at no cost. We will take appropriate steps to ensure your information is accurate, complete, and current.
If we decline to make requested corrections, you will receive a written notice explaining our decision (unless providing such explanation would be unreasonable), along with information about how you can file a complaint regarding our decision.
You maintain the right to opt out of marketing communications sent by us or by third parties to whom we have disclosed your personal information with your consent. This ensures you control the promotional content you receive.
To exercise any of these rights, please contact us in writing via email or postal mail using the contact details provided in section 11 below. We are committed to facilitating the exercise of your rights while maintaining compliance with applicable data protection regulations.
10. Policy Updates
We reserve the right to modify this Privacy and Cookies Policy at our discretion without advance notification. Any changes will become effective immediately upon posting the revised version on our Site. We encourage you to periodically review this page to stay informed about our information practices and your privacy options. Significant policy changes may be highlighted when implemented, but the most current version will always be available on our Site. Your continued use of our services following any modifications to this policy constitutes your acceptance of the updated terms.
